Terms of Service

This Service is currently in BETA. Features may change, be suspended, or terminated without notice. Use at your own risk. We are not liable for any data loss, service interruptions, or damages arising from use of this Service.

1. Definitions & Scope

These Terms govern your use of Off-Nadir Delta (the "Service"). The Service provides visualization and basic analysis of satellite data sourced from publicly available data catalogs (collectively "Data Sources"). Your use is subject to these Terms and the terms of the Data Sources (e.g., Copernicus Legal Notice, collection-specific terms). In case of conflict, the Data Source terms prevail for the relevant data/features.

2. Service Overview

The Service enables browsing, visualization, and basic analysis of satellite imagery from open data collections including Copernicus Sentinel-1 (SAR) and Sentinel-2 (Optical). Image search and tile delivery utilize publicly available satellite data catalogs and cloud-optimized geospatial formats.

3. Eligibility & Acceptance

You may use the Service upon accepting these Terms. Users under 14 are not permitted. Minors must obtain parental consent. If using on behalf of an entity, you represent and warrant you have authority to bind that entity to these Terms.

4. Commercial Use & Plan-Based Features

Free Plan: Non-commercial use only (e.g., personal projects, academic research, educational purposes). Commercial use including business operations, client deliverables, paid distribution, or advertising revenue is prohibited on the Free Plan.

Paid Plans (Starter/Pro): Commercial use is permitted according to your subscription plan. Commercial users must subscribe to an appropriate paid plan that matches their usage requirements.

Features, capabilities, and usage limits vary by plan. You are responsible for ensuring your usage complies with your current plan's terms and limitations.

5. Account Management

You provide an email address and password upon registration. Sharing or lending credentials, including API keys, is prohibited. We may suspend or terminate accounts upon suspected misuse. We do not store passwords in plaintext. Passwords are stored as salted hashes using a strong one-way key derivation function (e.g., bcrypt), and all credential exchanges occur over encrypted channels (TLS).

6. Data Ownership & Licensing

Data Sources

The Service accesses satellite imagery from publicly available open data sources, including Copernicus Sentinel-1 (SAR) and Sentinel-2 (Optical) Collections.

Copernicus Sentinel Data

Copernicus Sentinel data is governed by the EU Legal Notice. Attribution is required upon distribution/publication, such as:

  • "Copernicus Sentinel data [YYYY]"
  • "Contains modified Copernicus Sentinel data [YYYY]"

Processed Data

For outputs generated/exported via the Service, you must include appropriate attribution as required by the data source (e.g., "Contains modified Copernicus Sentinel data [YYYY] processed via Off-Nadir Delta").

Attribution for Service-Generated Outputs

All outputs created, processed, or exported using this Service must include appropriate credit attribution when published, distributed, or shared publicly. This requirement applies to all plan types (Free, Starter, and Pro).

This attribution requirement does not apply to outputs used solely for internal purposes without public distribution or publication.

Service Rights

Rights in the Service's UI, logos, and software belong to the service operator or licensors. The Service is independently developed and operated by a small independent provider and is not affiliated with any other organization.

7. Use of Retrieved Data

Data retrieved/processed via the Service must be used in accordance with your plan (non-commercial for Free Plan, commercial permitted for Paid Plans) and the terms of the original data sources. You must not remove or alter attribution/watermarks or conceal sources. Mass download, scraping, or caching that exceeds reasonable/fair use is prohibited. You must comply with export-control and sanctions laws.

8. Prohibited Conduct

The following conduct is strictly prohibited:

  • Violations of laws/public policy, or sanctions/export-control laws
  • Breach of data source provider terms (Copernicus, Microsoft, etc.)
  • Commercial use on Free Plan
  • Sharing credentials, impersonation, unauthorized access
  • Scraping, reverse engineering, or rate-limit circumvention
  • Interference with or disruption of the Service or third parties
  • Any violation of these Terms or applicable policies

9. User-Uploaded Data

The Service allows you to upload geospatial data files (such as GeoTIFF, GeoJSON, and similar formats).You are solely responsible for all data you upload to the Service.

9.1 Your Responsibilities

By uploading data to the Service, you represent and warrant that:

  • You own or have the legal right to use and upload the data
  • The data does not infringe any third-party rights (including copyright, trademark, privacy, or other intellectual property rights)
  • The data does not violate any applicable laws, regulations, or public policy
  • The data does not contain illegal, harmful, defamatory, or otherwise objectionable content
  • You have obtained all necessary permissions and consents for any personal data contained in the uploaded files

9.2 Disclaimer of Liability

The Service operator assumes no responsibility for the content, accuracy, legality, or appropriateness of any data uploaded by users. We do not review, verify, or endorse user-uploaded data. Any reliance on user-uploaded data is at your own risk.

9.3 Third-Party Claims

If any third party makes a claim against us relating to data you have uploaded (including but not limited to intellectual property infringement, privacy violations, or defamation), you agree to indemnify, defend, and hold us harmless from any resulting damages, costs, and expenses (including reasonable attorney fees).

9.4 Right to Remove

We reserve the right to remove or disable access to any uploaded data at our sole discretion, without prior notice, if we believe it may violate these Terms, infringe third-party rights, or for any other reason.

10. Privacy and Cookies

We process only the minimum personal data necessary for authentication, notifications, abuse prevention, and service delivery (e.g., email address, IP address, logs). We generally do not collect names or physical addresses. Purposes of use include account administration, identity verification, security monitoring, and legal compliance. We do not sell personal data. We may use processors (e.g., cloud providers) under appropriate contracts and oversight. Retention is limited to what is necessary; data that is no longer needed is deleted securely. Users may exercise rights of access, correction, suspension, and deletion under applicable laws. In the event of a security incident, we will provide notifications to authorities and affected users as required by law. See our separate Privacy Policy for details.

We also collect and analyze certain usage data about how you interact with the Service. This may include, for example, information about map views and satellite imagery you access, approximate geographic areas you browse, the types of satellite collections you use, and token or API usage associated with your account. We use this usage data to operate, maintain, and improve the Service, including analyzing usage patterns and developing or refining features. Such usage data may also be aggregated or de-identified and used to generate usage statistics and reports, as further described in our separate Privacy Policy.

Cookie Consent: By creating an account and agreeing to these Terms, you consent to our use of cookies and similar tracking technologies as described in our Privacy Policy. We use essential cookies for authentication and session management, as well as analytics tools for performance monitoring. You may manage your browser settings to control cookies, though disabling essential cookies may affect service functionality.

11. Service Provision & Fair Use

Beta Service: This Service is provided as-is in beta status. Due to maintenance, development changes, outages, excessive use, or policy changes at data providers, the Service may be modified, suspended, or terminated without notice. We may throttle or suspend usage in cases of excessive load. As a small independently operated service, support is provided on a best-effort basis.

12. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. This includes but is not limited to warranties of accuracy, completeness, fitness for a particular purpose, availability, merchantability, or non-infringement. As a beta service operated by a small independent provider, we make no guarantees regarding uptime, data accuracy, feature availability, or suitability for any specific use case.

13. Limitation of Liability

To the fullest extent permitted by law, the Service operator is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes but is not limited to data loss, service interruptions, errors, inaccuracies, business losses, or any other damages, even if advised of the possibility. As a small independently operated service provided on a best-effort basis, you use this Service entirely at your own risk. We are not responsible for disputes between users or between users and third parties. The limitations in this section apply except in cases of willful misconduct or gross negligence, to the extent not prohibited by applicable law.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified within the Service. Your continued use after changes constitutes acceptance.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan (excluding conflict-of-law rules). The Tokyo District Court shall have exclusive jurisdiction for the first instance over any disputes arising out of or relating to the Service.
